India didn't win Jadhav case: Pakistan's ICJ lawyer

22 May 2017, 06:18 | Nichole Osborne

Mr. Katju was quoted as saying in a social media post, "People are gloating over India's victory before the ICJ regarding Kulbhushan Jadhav". The Pakistani team has enough evidence to present against Jadhav, Aziz said.

The order comes ten days after India approached the UN's top court for "provisional measure" of protection - an interim relief - in the Jadhav case. Furthermore, he said, the Europeans were staunchly opposed to the death penalty.

"The case itself is weak, whether Pakistan file a plea or not the case will remain as it is and the ICJ will stand firm in providing legal access to Kulbhushan Jadhav and also that the death sentence should be stayed", defence expert Colonel Sunil Deshpande told ANI.

ICJ stays execution of Jadhav who is in Pak's custody. Third, fingers are being raised at Pakistan's ability to take up the issue at the global level, confirming the suspicions and conspiracies of many that most of the terrorism (or even political disharmony) in Pakistan is a effect of foreign activity.

The PPP lawmaker also criticized Home Minister Chaudhry Nisar Ali Khan and regarded him as a person with ill rationale. "We can give them refuge here", Jha said.

Khan claimed Jadhav's arrest prevented more acts of terror which his network had planned.

"Jadhav has been sentenced according to the constitution of Pakistan because he was arrested in the country and was involved in anti-state activities", the Minister said. He said the ICJ has not decided on consular access either and has only intimated that the matter will come under debate.

"The order issued by the ICJ is just a procedural order to enable full hearing". The final ruling by the tribunal on the case and whether it has jurisdiction to hear India's case could take months, if not years.

"The Kashmir issue must be dealt with the assistance of respective arrangements and Pakistan has no privilege to drag India to the ICJ on the Kashmir issue", Chacko included. The Pakistani authorities then asked him to show his visa documents, but the man said that he does not have any such documents.
