Three Chicago police officers were indicted Tuesday on felony charges that they conspired to cover up the actions of a white police officer who shot and killed 17-year-old Laquan McDonald, saying the officers lied when they alleged the teenager "aggressively" swung a knife at officers and attempted to get up from the ground still armed with the knife after he was shot.

David March, Joseph Walsh and Thomas Gaffney were each charged with conspiracy, official misconduct and obstruction of justice.

"Further, the indictment makes clear that these defendants did more than merely obey an unofficial 'code of silence", Holds said in the statement.

Holmes said the grand jury probe is contuning.

Video released in 2015 showed white officer Van Dyke shooting McDonald 16 times as the teen was apparently walking away from officers. The accounts of several officers dramatically differed from the dashcam video. He also pleaded not guilty to murder in 2015 and is awaiting trial.

The indictment says there are other individuals that may be part of the conspiracy, but Holmes wouldn't comment on whether other officers will be indicted.


March, 58, is a police veteran of more than 30 years and is the detective who prepared the reports on the shooting that indicated it was justified.

Chicago PD did not immediately respond to a request for comment on whether the officers charged Tuesday are still active members of the force. All three men are expected to be arraigned July 10 at the Leighton Criminal Courthouse.

The Inspector General found that Walsh, 48, made numerous false statements and material omissions in his interview with police and the Independent Police Review Authority, which investigates police shootings.

The three officers allegedly colluded to prevent an investigation into the October 20, 2014, death of McDonald, the black teen fatally shot by Officer Jason Van Dyke, who is white. According to Holmes, March, Walsh and Gaffney, 43, "conspired in the critical early hours and days... to hide the true facts of the events surrounding the killing of Laquan McDonald... to shield their fellow officer from criminal investigation and prosecution".

Despite what the video captured, one police report said the footage "was viewed and found to be consistent with the accounts of all the witnesses". March, Walsh and Gaffney allegedly conspired shortly after the shooting to shield their fellow officer from a criminal investigation and prosecution, according to the indictment.
