Commerce Department sides with Boeing on CSeries tariff

Commerce sets final duties on Bombardier totaling almost 300 percent

"The Commerce Department announced total duties of 292.21 percent - a final antidumping rate of 72.82 percent and a final countervailing duty rate of 212.39 percent - in a case brought by Chicago-based Boeing". If no injury is found, the ITC could terminate the Commerce Department's tariff. "The C Series would not even exist at this point but for those subsidies", Boeing said in a statement emailed during Bombardier's panel remarks.

Airbus, Boeing's European rival, reached a deal with Bombardier in October to purchase a 50.01 per cent stake in the C Series commercial jet and plans to build an assembly line in Alabama for American customers while maintaining the primary line in Mirabel, Que.

The US Commerce Department announced on 20 December that Bombardier CS100s ordered by Delta Air Lines could face a 292.21% tariff if they cross into the U.S. in a partially or fully assembled state.

But Bombardier argues that Boeing isn't threatened by the sales of the C Series because it doesn't sell an 100-seat airplane to suit the needs of airlines like Delta, which ordered 75 planes in April 2016 to update its fleet.

Boeing claims Delta paid $20 million per plane, well below an estimated cost of $33 million and what Bombardier charges in Canada. Investigations "established beyond question that Bombardier has taken billions of dollars in illegal government subsidies to prop up its C Series program", Boeing said after the hearing.

The U.S. Department of Commerce was due to finalize the proposed duties on Monday or Tuesday.


The partnership with Airbus means there is "no chance Boeing will be harmed by imports", said Mike Nadolski, vice president of public affairs at Bombardier. The plan would create a new wrinkle because the planes would effectively be a US product.

"A single large order, like Bombardier's sale to Delta, takes years of demand out of the market".

Boeing argues that Bombardier signed a deal to sell its new single-aisle CS 100 planes with a price tag of just $19.6 million each, far below the $33.2 million construction cost, and a pittance compared with the list price of $79.5 million - though that amount is nearly never paid.

Susan Fitzgerald, the Unite regional officer for Bombardier in NI said: "This decision poses a devastating risk for the Northern Ireland economy".

Bombardier also argues that Boeing and Airbus do not compete with the CSeries because their planes are larger and have more range.
