Spotify Slapped With $1.6 Billion Copyright Infringement Lawsuit
In its lawsuit, filed in federal court in California on December 29, Wixen Music Publishing is seeking a whopping $1.6 billion-plus dollars from Spotify.
Wixen, an exclusive licensee of songs such as "Free Fallin" by Tom Petty, "Light My Fire" by the Doors, (Girl We Got a) Good Thing by Weezer and works of singers such as Stevie Nicks, is seeking damages worth at least $1.6bn (£1.2bn) along with injunctive relief.
Music-streaming service Spotify has allegedly been using thousands of songs without the proper licenses.
While Spotify has yet to comment on the lawsuit, it previously responded to Wixen's settlement objection by questioning its authority to represent its clients in matters of litigation. In addition, Spotify will also have to create some sort of method to identify and license songs properly.
In a report from Hollywood Reporter, they say Spotify is getting hit with a $1.6 billion lawsuit from Wixen Music Publishing. They're arguing that Wixen's contract with their songwriters won't let them take legal actions on the songwriters behalf.
The complaint alleges that as much as 21 percent of the 30 million songs on Spotify are not licensed for use.
I've reached out to Spotify and Wixen.
A recent proposed settlement involving rights holders and Spotify in the class action lawsuit Ferrick et al. v. Spotify USA Inc.et al does not adequately compensate Wixen or the songwriters it represents. I'll update this story if I hear back. Wixen is an independent music publisher that was formed in 1978 by Randall Wixen.
