"In some cases if we're not, for example, aware of where the parent is, I can't commit to saying that reunification will be able to occur by the deadline".

But the process is likely to take longer for the dozens of parents who are not in government custody.

HHS has further confirmed with the Department of Homeland Security that about 40 parents of children under 5 are in its custody and another nine are in the custody of the U.S. Marshals Service. Fabian cautioned that those numbers were approximate and could be "in flux" over the coming days.

The administration says federal law requires it to ensure that children are safe and that requires more time.

The judge noted that "the government readily keeps track of personal property of detainees in criminal and immigration proceedings. yet the government has no system in place to keep track of, provide effective communication with, and promptly produce alien children". But since June 26, they've refused to specify how many kids from separated families remain in custody. "But no one can make any informed decision, including the court, without additional information". And by July 26, all children should be reunited with their parents.

The judge ordered the government to deliver a list of the children's names to the American Civil Liberties Union, which brought the lawsuit, by Saturday and said he would decide Monday whether to grant an extension.

According to an administration official, the DOJ now believes the government is on track to reunify nearly all of the those currently eligible by tomorrow, CBS News' Paula Reid reports.

Sabraw rejected that argument and reaffirmed that the deported parents, however many they may be, are part of the class action.

In Friday's legal request - the government asked for more time and clarification on if their current process for confirming parentage is consistent with the court's mandate and "seeks clarification that in cases where parentage can not be confirmed quickly, HHS will not be in violation of the Court's order if reunification occurs outside of the timelines provided by the Court". He also said that adults can not be deported from the United States without their children.
